Terms
Adirondack Real Estate Photography 1. Services Adirondack Real Estate Photography (“Company,” “we,” “us”) provides professional real estate photography, video, aerial (drone), and related media services for marketing purposes. Services are rendered as agreed upon at the time of booking. 2. Booking & Scheduling All services must be scheduled in advance. Booking a session constitutes acceptance of these Terms and Conditions. The client is responsible for ensuring timely access to the property. Delays caused by the client, occupants, weather, or access issues may result in rescheduling or additional fees.
3. Pricing & Payment Pricing is provided prior to the session based on selected services. Payment is due according to invoice terms, typically upon delivery unless otherwise agreed in writing. Late payments may result in delayed delivery and/or additional fees. Prices are subject to change without notice.
4. Cancellations & Rescheduling Cancellations or rescheduling requests must be made at least 24 hours before the scheduled session. Late cancellations or no-shows may be subject to a cancellation fee. Weather-related rescheduling, including drone restrictions, will be handled at the Company’s discretion.
5. Property Preparation The client is responsible for preparing the property prior to the session. The Company does not provide cleaning, staging, furniture moving, or item removal unless agreed upon in advance. Minor digital enhancements may be applied; extensive retouching is not included unless specified.
6. Creative Discretion The Company retains creative control over composition, lighting, angles, and editing style. Requests for specific shots or styles must be communicated prior to or during the session.
7. Turnaround Time Standard delivery time is 24–72 hours, depending on services booked. Delivery timelines are estimates and not guaranteed during peak seasons or unforeseen circumstances.
8. Copyright & Ownership All photographs, video, and aerial media remain the exclusive copyrighted property of Adirondack Real Estate Photography. No ownership rights are transferred to the client. 9. Standard License & Usage Rights (Included) Upon full payment, the client is granted a non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property photographed. Permitted uses include: MLS listings Real estate brokerage and agent websites Social media Printed property marketing materials
Media may not be: Reused for another property Sold, transferred, or sublicensed Used by third parties (builders, designers, stagers, developers) Used for branding, advertising, or commercial promotion without a Commercial Licensing Upgrade. 10. Alteration of Media Clients may not apply filters, edits, or alterations that misrepresent the Company’s work. Cropping and resizing for MLS or layout purposes are permitted.
11. Commercial Licensing Upgrade A Commercial Licensing Upgrade is available for clients requiring broader usage rights beyond standard real estate marketing. a. When a Commercial License Is Required A commercial license is required for, but not limited to: Builder, developer, or investor marketing Long-term branding or advertising campaigns Website hero images not tied to an active listing Print ads, billboards, brochures, or magazines Reuse of media after a property has sold Use by third parties not directly representing the listing agent
b. License Scope Commercial licensing fees are based on: Intended usage Distribution channels Duration of use Media type (photo, video, drone)
Licenses are granted in writing and do not transfer copyright ownership. c. Unauthorized Commercial Use Use of media outside the standard license without purchasing a commercial license constitutes copyright infringement and may result in additional licensing fees or legal action.
12. Aerial & Drone Services a. Regulatory Compliance All drone operations are conducted by an FAA Part 107–certified pilot and comply with all applicable Federal Aviation Administration (FAA) regulations, airspace authorizations, and safety requirements. b. Airspace & Location Restrictions Drone services may be restricted or prohibited due to: Controlled or restricted airspace Proximity to airports, helipads, or government facilities Temporary Flight Restrictions (TFRs) Local ordinances or property-specific rules
If authorization cannot be obtained, the Company may cancel or substitute drone services with ground-based photography at its discretion. c. Weather & Safety Conditions Drone flights depend on safe weather conditions. The Company reserves the right to cancel or reschedule drone services if conditions are unsafe, even after arrival. d. Property & Site Conditions The client is responsible for ensuring permission to operate drones on the property and that pets, people, and vehicles are kept clear of the flight area. e. Privacy & Neighbor Awareness The Company is not responsible for objections or disputes from neighbors or third parties related to drone operations. f. Cancellation, Substitution & Fees If drone services are canceled due to airspace, weather, or safety restrictions, the drone portion may be refunded or rescheduled. Completed ground services remain billable. g. Usage Limitations Aerial media is subject to the same licensing terms as ground media.
13. Liability The Company is not liable for property damage, personal injury, or loss caused by property conditions, occupants, pets, or third parties. Liability is limited to the amount paid for services. 14. Indemnification The client agrees to indemnify and hold harmless Adirondack Real Estate Photography from claims arising from use of the media or conditions at the property. 15. Model & Property Release The client warrants authority to permit photography and video of the property. Unless requested otherwise in writing before the session, the Company may use media for portfolio, website, and promotional purposes. 16. Force Majeure The Company is not responsible for failure to perform due to events beyond its control, including weather, illness, equipment failure, or government restrictions. 17. Governing Law These Terms and Conditions are governed by the laws of the State of New York. 18. Acceptance By booking or using the Company’s services, the client acknowledges they have read, understood, and agree to these Terms and Conditions.
